The war that began on October 7, 2023, has become the most destructive conflict in the modern history of Palestine. The International Court of Justice (ICJ) has found a “plausible” risk of genocide, and the International Criminal Court (ICC) has issued arrest warrants for Israeli leaders. The scale of death, displacement, and destruction is unprecedented.

The Human Toll

Destruction of Infrastructure

• 70%+ Buildings — Damaged or completely destroyed (satellite data).
• All 12 Universities — Bombed, demolished, or rendered inoperable.
• 390+ Schools — Destroyed, leaving a generation without education.
• 31 of 36 Hospitals — Non-functional due to attacks, fuel shortages, and siege.
• 70% Agricultural Land — Destroyed, including greenhouses and orchards.

Famine & Siege

The IPC (Integrated Food Security Phase Classification) has confirmed famine conditions in parts of Gaza. Israel has systematically blocked humanitarian aid, with 2–3 liters of water per person per day (WHO standard is 15 liters). Children have died of starvation and dehydration. The ICC arrest warrants specifically cite “starvation as a method of warfare.”

Ceasefire Breakdown

• Nov 2023 1-Week Truce: 105 hostages exchanged for 240 Palestinian prisoners.
• Jan 2025 3-Phase Deal: Hostage exchange and partial Israeli withdrawal. 1,900+ Palestinian prisoners released.

The two-state solution — an independent Palestine alongside Israel based on 1967 borders — has been the cornerstone of international diplomacy for decades. Yet after 30+ years of the Oslo “peace process,” the reality on the ground makes a viable, sovereign Palestinian state increasingly difficult to imagine. As UN Secretary-General António Guterres warned, the two-state solution is being “strangled” by the occupation.

The Territorial Reality

Area C — the majority of the West Bank — contains all illegal settlements, most agricultural land, and water resources. The West Bank is fragmented into 227+ disconnected enclaves, making territorial contiguity for a state nearly impossible.

Obstacles to Two States

• Settlements: 700,000+ Israeli settlers in the West Bank/East Jerusalem. Evacuation is politically impossible in Israel’s current political climate.
• Jerusalem: Israel has annexed East Jerusalem and declared the city its “complete and united capital,” rejected by the international community.
• Gaza-West Bank Split: Hamas controls Gaza, the PA controls parts of the West Bank — no unified Palestinian leadership.
• Refugees: The right of return for 5.9 million registered refugees remains unresolved.
• Security: Israel demands permanent military control over the Jordan Valley and airspace.

Alternatives

Given the impossibility of partition, Palestinian and international intellectuals have proposed alternatives:

• One Democratic State: Equal rights for all citizens between the Jordan River and the Mediterranean Sea (advocated by Edward Said, Rashid Khalidi, and many Palestinian civil society groups).
• Confederation: Two states with open borders, shared institutions, and freedom of movement (inspired by the EU model).
• Apartheid Reality: If current trends continue, the one-state reality is already here — but it is a state of Jewish supremacy, not equality (Amnesty, HRW, B’Tselem).

The period from 2021 to 2024 has witnessed an unprecedented legal reckoning for Israel’s occupation and military conduct. For the first time in history, the International Court of Justice (ICJ) has ruled that Israel’s entire occupation is illegal, and the International Criminal Court (ICC) has issued arrest warrants for Israeli leaders. These rulings have profound implications for international law and the global movement for Palestinian justice.

ICJ Genocide Case (South Africa v. Israel)

• Dec 2023 South Africa Files Case: Accusing Israel of violating the Genocide Convention in Gaza.
• Jan 2024 Provisional Measures: ICJ finds “plausible” risk of genocide and orders Israel to prevent acts of genocide and allow humanitarian aid.
• May 2024 Rafah Order: ICJ orders Israel to halt its military offensive in Rafah.
• Ongoing Final Verdict: Pending (will take years), but the preliminary rulings have already isolated Israel diplomatically.

ICJ Advisory Opinion (July 2024)

In a historic ruling, the ICJ declared Israel’s occupation of the West Bank, East Jerusalem, and Gaza illegal. The court ruled that Israel must evacuate all settlements, dismantle the wall, and pay reparations to Palestinians. The vote was 11-4 in favor (the US was among the dissenting judges).

ICC Arrest Warrants (Nov 2024)

The ICC issued arrest warrants for:

• Benjamin Netanyahu (Israeli PM) — For starvation as a method of warfare and directing attacks against civilians.
• Yoav Gallant (former Defense Minister) — Same charges.
• Mohammed Deif (Hamas military leader) — For war crimes committed on October 7, 2023.

These warrants mean that 124 ICC member states are legally obligated to arrest these individuals if they enter their territory.

Apartheid Findings

Three major human rights organizations have concluded that Israel’s treatment of Palestinians constitutes apartheid — a crime against humanity:
