US Vetoes at the UN Security Council

The International Court of Justice (ICJ) — the UN’s highest court — has issued three landmark rulings on Palestine. Each has strengthened the legal case against Israel’s occupation.

1. Wall Advisory Opinion (2004)

• 9 July 2004 Verdict: The Separation Wall is “contrary to international law”
• Key Findings: Wall violates Palestinians’ right to self-determination, freedom of movement, and access to land
• Order: Israel must dismantle the wall and pay compensation
• Status: Israel rejected the ruling; wall continues to expand

2. Occupation Advisory Opinion (19 July 2024)

• 19 July 2024 Verdict: Israel’s occupation of West Bank, East Jerusalem, and Gaza is ILLEGAL
• Vote: 11-4 in favor (US among dissenters)

The International Criminal Court (ICC) began investigating war crimes in Palestine in 2021. In November 2024, it issued historic arrest warrants against Israeli leaders — the first time in history that a Western-allied nation’s leaders have faced ICC prosecution.

What This Means

International Response

The apartheid findings have been endorsed by UN Special Rapporteurs, the South African government, and numerous legal scholars. Israel rejected the reports, calling them “antisemitic” — a claim rejected by the organizations, many of which are Jewish or Israeli.

The Fourth Geneva Convention (1949) governs the conduct of occupying powers. Israel has been found to be in systematic violation of multiple articles of this convention — the core treaty of international humanitarian law.
